Image and Voice Consent

This document explains what you authorize when you create your digital twin on viralizi.ai, and it records your consent to the use of your image, your voice and your biometric data. You accept it in the app before recording any video or voice sample: the capture only unlocks after you accept.

01Who processes your data

The controller is [RAZÃO SOCIAL], CNPJ [CNPJ], with its registered office at [ENDEREÇO] (viralizi.ai). Data Protection Officer: [ENCARREGADO (DPO)], [E-MAIL DE PRIVACIDADE].

This consent supplements the Terms of Use and the Privacy Policy.

02What data this consent covers

• the videos you record in the guided capture, including new looks and scenes you record later;
• samples of your voice;
• the avatar and voice models trained from them, which make up your digital twin;
• the consent confirmations described in section 7;
• the videos generated with your twin.

03What you authorize

You authorize viralizi.ai to use this data only to:

1. create, train, maintain and update your digital twin;
2. generate short videos with your face and voice, from scripts presented to you, in the languages you enable;
3. check that the person in the capture is the same person who gave this consent, to prevent fraud and anyone else using your likeness;
4. send videos for approval and post approved videos to the channels connected to the account with your permission;
5. if you ask for the free audit, generate a short sample with your twin so you can evaluate the service, as described in section 11.

04Limits: what we will not do

• Approved videos only. No video featuring your twin is posted without your approval, or that of someone you expressly authorize in the Service. The one exception is autopilot, which only you can switch on and off, at any time: while it is on, videos with no response within the period shown in the app (currently 48 hours) are treated as approved by you.
• Only the channels you authorize. Videos are posted only to the profiles connected to the account: your professional profile, or the profile of the clinic you belong to if you authorize it.
• Protected capture. In a clinic account, the raw video and audio of your capture are accessible only to you and to the viralizi.ai staff who run the Service. Other members see only the generated videos, according to their role.
• Freely given. The clinic cannot make your hiring, pay or continued work depend on this consent.
• No advertising for us without separate permission. We do not use your image, your voice or your twin in viralizi.ai ads, testimonials, case studies or collab posts unless you authorize it in a separate document.
• No sale and no other uses. We do not sell, license or hand over your twin to anyone. We do not use it to identify or track people, except for the check in section 3, or to create someone else's twin.
• No training of other AI. We do not use your biometric data to train general-purpose AI models, and we contractually require the same of the providers that work for us.
• No prohibited topics. Your twin will not be used for political or electoral advertising, or for any content prohibited by the Terms of Use.

05No payment

The permission to use your image and voice under this consent is given free of charge. It exists so that the service can be provided, and neither viralizi.ai nor you owes the other any payment for it. Any payment between you and the clinic for the use of your likeness is a matter between you and the clinic.

06Providers and international transfers

To create the twin and generate videos, your data is processed by HeyGen, the avatar provider, and by the AI providers [PROVEDORES DE IA], and stored on Cloudflare's infrastructure. Videos sent to you for approval pass through our messaging providers, [PROVEDORES DE E-MAIL, WHATSAPP E SUPORTE]. Some of these providers process data outside Brazil, mainly in the United States. By accepting this consent, you specifically consent to that international transfer of your biometric data (LGPD art. 33, VIII), which is also protected by the contractual safeguards described in the Privacy Policy. These providers may use your data only to provide their services to viralizi.ai.

07How you give consent

Acceptance in the app. Before any recording, right after you fill in your profile, you tick the box in the app, with your own login, confirming that you accept this document. We record the version accepted, the date, the time and the login used. That is your consent, and the capture only unlocks after it.

Identity confirmation. To prove that the person in the capture is the person who consented, you also choose one of these confirmations, which add to your acceptance and do not replace it:

1. reading the statement in section 13 aloud, looking at the camera, at the start of the capture video;
2. the consent statement recorded on HeyGen's page, through a link valid for 24 hours;
3. uploading this document, signed by you, in the app, with an identity check.

We keep these records to prove your consent (LGPD art. 8, § 2). Consent is personal: only you can give it, and no one, including the clinic or an account administrator, can consent on your behalf.

08How long it lasts

This consent applies from the moment you accept it until the first of these happens:

• you withdraw consent;
• your account, or your access to the clinic's account, is closed;
• [PRAZO DE INATIVIDADE] pass without any interaction from you with the Service.

New recordings, such as extra looks and scenes, are covered by this same consent while it is in effect. If we change the purposes described here, we will ask for new consent.

09How to withdraw

You can withdraw this consent at any time, free of charge:

• in the app, under Twin › Revoke; or
• by emailing [E-MAIL DE PRIVACIDADE] from your account email.

When you withdraw:

• generation of new videos with your twin stops immediately, and scheduled videos that have not been posted yet are cancelled;
• your twin, your biometric data and the videos generated with it are deleted as described in section 10;
• videos already posted to your own profile stay there, under your control, and you can delete them directly on the social network;
• videos already posted to the clinic's profile are under the clinic's control; the clinic must stop using your twin and, at your request, remove them, as set out in the Terms of Use;
• processing carried out before you withdrew remains valid (LGPD art. 8, § 5).

Withdrawing has no fee or cost for you. Because the twin is needed for the videos, the Customer who bought the plan may cancel the subscription, or remove your items from the plan, without any minimum-term fee, as set out in the Terms of Use. If you want to keep generated videos, download them before withdrawing, where downloading is available.

10Deletion

When consent ends, for any reason, we delete within [PRAZO DE EXCLUSÃO BIOMÉTRICA]:

• the capture videos and voice samples;
• the avatar and voice models of your twin. We also instruct the AI providers to delete them, which they complete within [PRAZO DE EXCLUSÃO NOS PROVEDORES];
• the videos generated with your twin that are stored in the Service's library.

The only exception is proof of consent: we keep the records of acceptance, withdrawal, video approvals and autopilot activation and, where applicable, only the part of the recording in which you read the statement in section 13. This material is locked against any other use and kept for [PRAZO DE GUARDA DOS REGISTROS DE CONSENTIMENTO], solely to show that we complied with the law and to defend legal claims (LGPD art. 8, § 2, and art. 11, II, a and d).

Backups are removed in the rotation cycle, within [PRAZO DE BACKUP]. In any case, including deletion and backups, no biometric data other than the proof of consent is kept longer than [PRAZO MÁXIMO DE RETENÇÃO BIOMÉTRICA] after your last interaction with the Service.

11Free audit

If you ask for the free audit before signing up, the sample with your twin is only generated after you accept this document in the audit form and confirm that the videos and profile you provided are your own. The videos, voice, model and sample produced for the audit are deleted within [PRAZO DA AMOSTRA DO DIAGNÓSTICO] if you do not sign up. You can withdraw this consent before then, at any time, by writing to [E-MAIL DE PRIVACIDADE].

12Your rights and your statements

You have all the rights described in the Privacy Policy, including the rights to access, correct and delete your data.

By consenting, you confirm that:

• you are the person who appears in the capture and whose voice was recorded, and you are at least 18 years old;
• you consent freely, without pressure from the clinic or anyone else;
• you have read this document and understand that the generated videos show you saying words you did not personally record;
• you will review every video before approving it, or leave autopilot on knowing that it approves for you, and you are responsible for the content approved, including before your professional body.

13Consent statement

Text accepted in the app, and read aloud when the confirmation is given in the capture video:

This consent is also published in Portuguese at /br/consentimento. Your consent applies to the version you accepted; both versions have the same content.
